Terms of Service

The short version

Our apps are provided as they are, for your personal use. We do our best to keep them accurate and available, but we can’t promise either. Anything an app shows you about value or price is an estimate — not advice, and not a guarantee. Your data is yours; see the Privacy Policy for how we handle it.

Who these terms are between

These terms are an agreement between you and Xandelea, an independent app studio operated by Peter Gray. They apply to xandelea.com and to our apps, including Brick Tracker, Encore, and Split Photo. By using an app or this site, you agree to them. If you don’t agree, please don’t use them.

Using our apps

Personal use. Our apps are licensed to you for personal, non-commercial use. You may not resell them, redistribute them, or use them to build a competing product.

Your account. Where an app offers an account, you are responsible for keeping access to it secure. You can delete your account from within the app at any time.

Fair use. Please don’t attempt to disrupt our services, extract data in bulk, circumvent rate limits, or use an app in a way that breaches the terms of the data sources it relies on.

Information accuracy, and what it isn’t

Estimates are estimates. Set valuations, market values, retail prices, stock availability, retirement dates, and any similar figures are estimates compiled from third-party sources. They may be wrong, out of date, or incomplete.

Not advice. Nothing in our apps is financial, investment, or appraisal advice. A valuation is not an offer to buy, a guarantee of what something will sell for, or a substitute for a professional appraisal or an insurance valuation. Decisions you take on the basis of anything an app shows you are your own.

Third-party data and trademarks

Our apps display information from third parties, each of which owns its own data and marks. Brick Tracker uses set information from Brickset, resale data derived from BrickLink, and retail prices published by individual retailers. Encore uses catalog data from TMDB, TVmaze, JustWatch, and MovieGlu.

The term ‘BrickLink’ is a trademark of the LEGO Group BrickLink. Brick Tracker uses the BrickLink API but is not endorsed or certified by LEGO BrickLink, Inc. LEGO® is a trademark of the LEGO Group, which does not sponsor, authorise, or endorse our apps. Brick Tracker is not affiliated with the LEGO Group, BrickLink, or Brickset.

We provide our apps — the third parties named above do not. Any questions, problems, or support requests should come to us, not to them.

Availability and changes

We may change, suspend, or discontinue any part of an app or service at any time, including features that depend on a third-party source remaining available to us. We don’t guarantee uninterrupted or error-free operation.

We may update these terms. When we make a material change we will post it here and update the effective date above. Continuing to use an app after that means you accept the updated terms.

No warranty

Our apps and this website are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, in which case this exclusion applies to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, Xandelea will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of our apps or this website. Our total liability for any claim will not exceed the greater of the amount you paid us for the app in the twelve months before the claim, or 50 US dollars.

Nothing in these terms limits liability that cannot be limited by law.

Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. The courts of California will have exclusive jurisdiction over any dispute arising from them.
